Introduction

These Terms and Conditions ("Terms") set out how Arcadian Jewellers ("we", "us", "our") operates this website and supplies jewellery and related services. By using this website or placing an order, you agree to be bound by these Terms.

Nothing in these Terms limits or excludes your rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL).

1. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a remedy (such as a repair, replacement, or refund) where goods are faulty, not as described, or not fit for purpose, in accordance with Australian law.

2. Use of Website

You agree to use this website only for lawful purposes. You must not attempt to interfere with the website’s functionality, security, or accessibility.

3. Intellectual Property

All content on this website, including images, designs, text, logos, and branding, is the property of Arcadian Jewellers unless otherwise stated. You must not copy, reproduce, or use any content without prior written permission.

4. Products

Arcadian Jewellers offers a combination of ready-made and made-to-order jewellery. Product type will be specified on each individual listing or at the time of purchase.

Where items are made to order:

  • Each piece is individually crafted following confirmation of your order

  • Production begins once payment or an agreed deposit has been received

  • Lead times are estimates and may vary depending on design complexity and materials

As each piece may be handmade or finished by hand:

  • Minor variations in colour, gemstone appearance, texture, and finish may occur

  • Natural inclusions in gemstones are expected and are not considered defects

We may make minor technical or structural adjustments during production where necessary to ensure durability and craftsmanship, while maintaining the overall design intent.

5. Pricing and Payment

All prices are listed in Australian Dollars (AUD). As We are a very small business, we are not currently registered for GST and therefore it is not included in our prices. We will register for GST when necessary and include GST where applicable once we have reached the threshold.

For made-to-order pieces:

  • A non-refundable deposit may be required to commence production

  • The remaining balance must be paid prior to completion or dispatch unless otherwise agreed in writing

We reserve the right to update pricing prior to order confirmation.

6. Order Process and Design Approval

For custom or bespoke jewellery:

  • Design confirmation (including sketches, CAD designs, or stone selection) is required before production begins

  • Once approved, the design is considered final for production purposes

  • Any changes after approval may incur additional costs or delays

7. Cancellations

For made-to-order items:

  • Orders cannot be cancelled once production has commenced

  • Cancellation requests prior to production may be considered at our discretion

Nothing in this clause limits your rights under the Australian Consumer Law.

8. Shipping and Delivery

Delivery timeframes are estimates only and may vary due to production schedules or third-party carrier delays.

Risk in the goods passes to you upon delivery.

You are responsible for providing accurate shipping details at the time of order.

9. Returns and Refunds

Australian Consumer Law Rights

You are entitled to a remedy under the ACL if goods are faulty, not as described, or not fit for purpose.

Change of Mind

Returns or exchanges for change of mind are not accepted on any products, including both made-to-order and ready-made items, except where required under Australian Consumer Law.

10. Warranty & Liability Policy

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. Voluntary Warranty Coverage Periods

In addition to your rights under the Australian Consumer Law, Arcadian Jewellers (ABN: 18 212 658 218) provides a Voluntary Warranty on our items and services from the original date of purchase or completion:

  • Ready-Made Jewellery: 12 month warranty against manufacturing defects (subject to the Mandatory Checkup Condition in Section 5).

  • Custom-Made Jewellery: 12 month warranty against manufacturing defects in new materials and craftsmanship (subject to the Mandatory Checkup Condition in Section 5).

  • Repair and Modification Services: 90 day warranty strictly on the specific work performed or parts replaced during the repair.

  • Remodelling Services (Client-Supplied Materials): 90 day warranty strictly on our craftsmanship and new materials added (subject to the strict conditions in Section 3).

3. Special Terms for Remodelling (Client-Supplied Jewellery)

When we remodel or reinvent old jewellery supplied by you, we take the utmost professional care. However, because we are working with materials of unknown history, the following terms strictly apply:

  • Metal Melting and Refining: Older metals can contain brittle alloys, porosity, or internal solder lines. We cannot guarantee the exact structural behavior, porosity, or ultimate durability of melted and re-used client metal.

  • Gemstone Risks: Pre-owned gemstones and diamonds may have microscopic fractures, heat sensitivities, or internal stress points that are invisible until unset, cleaned, or subjected to torch heat. Arcadian Jewellers accepts no liability for stones that crack, chip, or break during unsetting, cleaning, or resetting if the cause is an inherent structural weakness of your gemstone.

  • Purity & Integrity: We accept your materials in good faith based on stamps or basic testing. We do not warranty the long-term structural integrity of the final piece if it relies solely on the purity of client-supplied metal.

4. Repairs Liability (Handling & Service Policy)

When you entrust your existing jewellery pieces to Arcadian Jewellers for repairs, restoration, resizing, or cleaning, the item is accepted subject to the following liability limits:

  • Pre-Repair Inspection & Found Conditions: We conduct a thorough assessment of your item upon intake to evaluate overall structural integrity, gemstone stability, and pre-existing wear. However, micro-fractures, internal gemstone inclusions, laser-drilling, fracture-filling, and deep structural fatigue caused by previous wearing or third-party alterations cannot always be detected until the item is actively worked on under intense torch heat or physical pressure.

  • Client Acceptance of Identified Risks: If our pre-repair inspection reveals notable structural weaknesses, thinning bands, worn prongs, or fragile stones, we will explicitly communicate these risks to you prior to starting any work. If you choose to proceed with the repair after being notified of these risks, you do so under the condition of Acceptance of Risk. Arcadian Jewellers holds absolutely no liability or financial responsibility if the identified component or gemstone fails, cracks, breaks, or degrades during or after the service.

  • Unserviced Areas & Subsequent Failures: Our 90 day repair warranty applies strictly to the exact area repaired or component replaced by us (e.g., if we retip a specific claw, only that claw is covered). We are not responsible for the failure of any other parts of the jewellery piece before, during, or after the fact if we did not perform work on that specific area.

  • Gemstone & Diamond Vulnerability: Certain gemstones (including but not limited to emeralds, opals, tanzanites, pearls, and treated stones) are naturally fragile and sensitive to heat, ultrasonic cleaning, or pressure. While we take every professional precaution, we accept no liability for damage to stones that fail due to pre-existing internal flaws or un-declared treatments.

  • Limitation of Liability for Accidental Damage: In the highly unlikely event that an item is damaged or lost directly due to gross negligence on our part while in our possession, our liability is strictly limited to the cost of repairing the damage or replacing the item with an equivalent piece of similar quality. We do not accept liability for sentimental, emotional, or non-economic loss.

5. Mandatory 6-Month Checkup Condition

To keep your 12 month Voluntary Warranty valid for ready-made and custom-made jewellery, you must return the item to our studio for a professional inspection and complimentary clean at 6 months of the purchase date.

  • This checkup allows us to inspect stone settings, claw tightness, and structural integrity to prevent damage or loss.

  • It is your responsibility to schedule and attend this checkup.

  • Failure to complete this 6 month inspection will void the remaining 6 months of the Voluntary Warranty.

6. Strict Exclusions (What is Not Covered)

  • This Voluntary Warranty is limited and does not cover damage resulting from:

  • Missed Inspections: Any issues arising after the 6 month mark if the mandatory checkup was not completed.

  • Customer Materials: Any failure, fracture, or defect rooted in client-supplied metal or gemstones used during a remodel.

  • Normal Wear and Tear: Gradual wear of metal plating (such as rhodium plating on white gold), thinning of bands, or surface scratches from daily use.

  • Accidental Damage or Misuse: Scratches, dents, cracks, or broken prongs caused by dropping, hitting, caught fabric, or rough handling.

  • Chemical Exposure: Discolouration, tarnishing, or damage to metals and organic gemstones (like pearls, opals, or emeralds) caused by exposure to perfumes, lotions, chlorine, pools, hot tubs, or cleaning products.

  • Loss or Theft: The loss of the entire item, or individual center stones that detach due to impact, neglect, or bent prongs.

  • Third-Party Modifications: Any sizing, alteration, repair, or polishing performed by a jeweller other than Arcadian Jewellers completely voids this warranty.

7. How to Make a Claim

To make a claim under this warranty, please follow these steps:

  1. Contact Us: Email us at arcadianjewellers@gmail.com or visit our studio at Shop 4/77 Redcliffe Parade, Redcliffe 4020 with your proof of purchase (receipt or invoice)

  2. Return the Item: You must return the jewellery piece to us for visual inspection and assessment. You are responsible for any postage, shipping, or insurance costs incurred when returning the item to us.

  3. Assessment: We will inspect the piece to determine if the issue is a covered defect or due to wear/accidental damage.

8. Remedies and Resolution

If we find a genuine manufacturing or craftsmanship defect, we will repair or replace the item at our expense. If a repair or identical replacement is not possible (such as a unique, one-of-a-kind gemstone), we will offer a store credit or a full refund. If we determine the damage is due to wear and tear, accidents, or neglect, we will provide you with a complimentary repair quote before performing any work.

11. Natural Stones and Materials

Gemstones and precious metals are natural materials and will vary in appearance.

Characteristics such as inclusions, colour variation, and texture are natural and contribute to the uniqueness of each piece and are not considered faults.

12. Limitation of Liability

To the extent permitted by law, our liability is limited to:

  • Replacement of goods, or

  • Repair of goods, or

  • Resupply of services, or

  • The cost of such replacement, repair, or resupply

Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.

13. Privacy

Your use of this website is also governed by our Privacy Policy.

14. Changes to Terms

We may update these Terms at any time by publishing changes on this website. Continued use of the website constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes are subject to the jurisdiction of Australian courts.
